Term: Agreement will begin with an initial 1 month term (if month to month sign up) or 12 month term (if annual sign up). Agreement is entered into between Letam Duson d/b/a Ley All Day, LLC (“Stylist”) and Purchaser (“Member”). Agreement is entered into on the date Member pays for the Ley All Day Style Club membership a year in full or the first month Member pays monthly membership fee if paying month to month and constitutes the entire understanding and agreement of the parties and no amendment, change or modification of Agreement shall be valid, unless in writing and signed by all parties hereto.
Refunds and Exchanges: By paying style club membership in full (a year’s worth of payments for either the Gold or Diamond Ley All Day Style Club membership), Member agrees that there will be no refunds or exchanges for any reason. All services and information are based on recommendation and Stylist expertise and shall not be construed as providing formal instruction to purchaser or recipient of gift from purchaser, but rather professional guidance. If paying month to month, Member may cancel any time. Whether annual or monthly, membership will automatically renew and membership fee will be charged once a year (for annual payments) or monthly (for month to month), unless Member cancels subscription before the next billing cycle. However, purchaser must cancel at least 60 days in advance of the next automatic payment date or risk being charged for the next billing cycle’s membership fee. Member must cancel subscription directly through PayPal. Stylist cannot cancel subscription for Member. There will be no prorating of any membership fee. Full monthly membership fee will be charged for the month Member signs up for if month to month payment and full year membership will be charged for annual sign ups. Results not guaranteed.
Dispute Resolution: Any controversy or claim arising out of, or relating to Agreement or the services provided, shall first be submitted to mediation for an attempt at resolution, with such mediation being conducted by a mutually agreeable party. If the dispute is not resolved by mediation, the dispute shall be settled by binding arbitration in Montgomery County, MD.
Attorney’s Fees: In the event of any dispute, litigation or arbitration between the parties, the non-prevailing party shall pay to the prevailing party therein all costs and expenses. This Agreement shall, in all respects, be governed by the laws of Maryland applicable to agreements executed and to be performed within Maryland.
